Individual Education Plans and Behavior Goals Managing difficult behavior is one of the challenges that makes or breaks effective instruction. Early Intervention If a childs behavior impacts his or her ability to perform academically, it requires a Functional Behavioral Analysis (FBA) and modify behavior informally, before you go to the lengths of an FBA and BIP. Avoid accusing parents or whining about behavior: if you gain the cooperation of parents early on you can avoid another IEP team meeting. Behavior Goal Guidelines Once you have established that you will need an FBA and BIP, then its time to write IEP Goals for behaviors. Write your goals positively as much as possible. Name the replacement behavior. Instead of writing Zachary will not hit his neighbors write Zachary will keep hands and feet to himself.Avoid preachy, values freighted words, especially responsible and accountable. When discussing with the student why feel free to use these words, such as Lucy, Im so happy youre being responsible for your temper. You used your words instead!! But goals should read: Lucy will present a card cue when she needs a time out to cool off 80 percent of the day (interval objective.) There are basically two kinds of objectives as noted above: interval and frequency goals. Interval goals are measured across intervals, and frequency goals measure the number of occurrences of a preferred or replacement behavior during a time period.The goal of behavior goals should be to extinguish, or eliminate, undesirable behavior and replace it with appropriate, productive behavior. Focusing on the target behavior may reinforce it. Focusing on the replacement behavior should help to extinguish the behavior. Problem behavior is not usually the result of reflective, thoughtful choices. It is usually emotional and has been learned by being rewarded. That doesnt mean you shouldnt talk about it, talk about the replacement behavior and talk about the emotional content of good behavior. It just doesnt belong in an IEP.There is no such thing as an attitude goal. Lets face it, weve all known kids who were nasty, negative or unpleasant, but we need to remember that attitude follows behavior. Once you have success, you can build a positive relationship. You cant dictate right attitude. You can model it. Kinds of Behavioral Goal Goals for Disruptive Behavior:Disruptive behavior is generally out of seat behavior, calling out behavior, and attention seeking behavior. Generally, the function of this sort of behavior is attention, though children with Attention Deficit Disorder (ADD) often do it because, well, thats who they are!ExamplesGoal for Out of Seat: During instruction (a Color Wheel Behavior Plan would be good for clarity, here,)Susan will remain in her seat 80 percent (4 of 5) of half hour intervals, two of three consecutive 2 1/2 hour probes.Calling Out: During instructional periods, Jonathon will raise his hand 4 of 5 (80%) of in-class participation occasions for three of four consecutive 45-minute probes.Attention Seeking Behavior: These goals can only be written when you have a good, operational description of the replacement behavior you want. Angela will throw herself on the floor to get her teachers attention. The replacement behavior is for Angela to use a pre-determined cue (a red cup on top o f the desk) to get the teachers attention. The goal would read: Angela will remain in her seat and cue the teacher for attention with a pre-agreed signal. Goals for Academic BehaviorAcademic behavior is behavior that supports academic progress, such as completing work, returning homework and meeting certain standards for neatness. Be sure behaviors support the childs progress, not your need for certain kinds of academic behaviors. Many of those things should be addressed under the rubric procedures.Completion of Assignments When given adapted math assignments of 10 or fewer problems, Rodney will finish 80% of assignments 2 out of 3 consecutive weeks.Homework: The behavior surrounding homework is composed of several component parts: recording assignments, doing the assignments at home, turning the assignment in. One adaptation for homework, especially for children with Aspergers syndrome would be to do 30 minutes of homework, ask the parents to time the work section and initial it. Tantrumming: Tantrumming is often more than one behavior, and you need to decide at what point intervention will eliminate the tantrum. A functional analysis is vital: what functional purpose does the tantrum serve? To avoid work? To avoid certain tasks or situations? Maybe you just need to change how work demands are made and how choices are proffered to the child. To get preferred item? Because the child is overtired and needs to escape all demands? Knowing the function of the behavior and the childs preferences can avoid a lot of tantrums. Our imaginary student, Cloe, tends to tantrum when she overly tired. The replacement behavior is to ask for a break/rest, where the classroom aide will place Cloe on her side on a mat, with her head elevatedWhen Cloe is tired, she will present the teacher or classroom aide with the picture exchange card for a break, 4 of 5 episodes (4 requests for each tantrum) or 80% of occasions, 3 of 4 weeks.

Female Knights There are plenty of fierce women who have battled their way through history in politics and warfare. Although from an academic standpoint women could not generally carry the title of knight, there were still many women in European history who were part of chivalric orders and performed the duties of female knights without the formal recognition. Because neither of these were typically the domains of women, it was rare for a women to carry the title of knight. However, in parts of Europe, there were chivalric orders of knighthood that were open to women. During the early medieval period, a group of devout Christian knights joined together to form the Knights Templar. Their mission was twofold: to protect European travelers on pilgrimage in the Holy Land, but also to carry out secret military operations.  When they finally took the time to write down a list of their rules, around 1129 C.E., their mandates mentioned a pre-existing practice of admitting women to the Knights Templar. Their role was an auxiliary one, often related to support and hospital services during times of war, including on the battlefield. In the mid-12th century, Moorish invaders laid the town of Tortosa, Spain, under siege. They dressed in mens clothing- which was certainly easier to fight in- picked up weapons, and held their town with an array of swords, farm implements, and hatchets. It is not known whether the women of the Order ever fought in any battles other than defending Tortosa. The group faded into obscurity as its members aged and died out. Women in Warfare During the Middle Ages, women were not raised for battle like their male counterparts, who typically trained for warfare from boyhood. However, that doesnt mean they didnt fight. There are numerous examples of women, both noble and lower-born, who defended their homes, their families, and their nations from attacking outside forces. Nearly all of the citys fighting men had marched out of town three months earlier, for the Battle of Hattin, leaving Jerusalem unguarded but for a few hastily-knighted boys. The women, however, outnumbered men in the city by nearly 50 to 1, so when Balian, Baron of Ibelin, realized it was time to defend the walls against the invading army of Saladin, he enlisted the female citizens to get to work. When her spouses were away, Nicholaa ran the show. William Longchamps, a chancellor of Richard I, was heading to Nottingham to battle against Prince John, and along the way, he stopped at Lincoln, laying siege to Nicholaas castle. She defended her home again a few years later when Prince Louis of France tried to invade Lincoln. Women didnt just show up and perform the duties of knights in defensive mode. There are several accounts of queens who traveled into the field with their armies in times of war. Eleanor of Aquitaine, the Queen of both France and England, led a pilgrimage to the Holy Land. She even did it while dressed in armor and carrying a lance, although she didnt personally fight. During the War of the Roses, Marguerite d’Anjou personally directed the actions of Lancastrian commanders during battles against Yorkist opponents while her husband, King Henry VI, was incapacitated by bouts of madness. In fact, in 1460, she defeated the threat to her husband’s throne by calling on the Lancastrian nobility to assemble a mighty host in Yorkshire that ambushed York and killed him and 2,500 of his men outside his ancestral home at Sandal Castle. Finally, its important to note that over the centuries, there were countless other women who donned armor and rode into war. We know this because although medieval European writers documenting the Crusades emphasized the notion that pious Christian women did not fight, the historians of their Muslim opponents wrote of crusading women battling against them. The Persian scholar Imad ad-din al-Isfahani wrote, a woman of high rank arrived by sea in late autumn 1189, with an escort of 500 knights with  their forces, squires, pages and valets. She paid all their expenses and also led them in  raids on the Muslims. He went on to say that there were many female knights among the Christians, who wore armour like the men and fought like men in battle, and could not be told apart from  the men until they were killed and the armour was stripped from their bodies. Although their names have been lost to history, these women did exist, they simply were not granted the title of knight. This is because, it allows the setting to run smoothly as everyone knows what they need to do and when. Operational systems and financial systems are important elements of a business plan which enable a service to run efficiently. There are many operational systems and financial systems involved in a service. Task 2: Structure of the day: There are many ways in which this operational system impact on early years or play works services. It allows everyone to know their roles and what they need to do throughout the day. This will allow the service to run smoothly as people will not be wondering what needs to be done and things will then get done correctly instead of being left. Due to this, things like forms for the amount children eat and their behaviour will also be carried out correctly as there will be a designated member of staff who has to fill in the paper work for the room they are working in by the end of the day. If the setting has structured the day well enough then the member of staff will have time to write up the information as it comes instead of doing it all at the end of the day. This is because, if the practitioner leaves it until the end of the day, they may forget important bits of information and therefore will not be able to report back to parents correctly. This operational system also helps to keep the organised. However, there are a few problems with this operational system. If a member of staff rings in sick then it may be hard to find cover and therefore, the structure of the day will be jeopardised. Due to this, the day will not run smoothly as there will not be enough members of staff in the setting, meaning that everyone will be panicking and jobs and paperwork will not get done correctly. Especially if the member of staff who has rang in sick is designated with important jobs for that day. It may also be the case that other people are unaware of how to carry out the member of staff jobs and therefore, they will not get done until that member of staff comes into work. If some job roles are linked together, i.e. paperwork then this could also mean that other jobs cannot get done. As a result, the structure of the day will be ruined and the setting will not run smoothly. For this operational system to work effectively there needs to be correct effective communication in place. However, if this does not happen then this operational system wills no work. Health and safety: This operational system has a huge impact on early years or play works services, and it is very important to keep a service running smoothly and effectively. However, there are many positive and negatives points to this operational system. It keeps staff, children, visitors and anyone who may enter or work in the service safe. This happens as the operational system will include task like carrying out a risk assessment daily to reduce the risk of hazards and anyone getting injured. Due to this, the system can be made suitable to the specific setting as each setting may have different hazards. Also, each setting has different health and safety requirements; this is why it is important to have an operation system to each individual service so it fits in correctly and will work appropriately. This system will outline the procedures the staffs need to know and follow to abide to the healthy and safety rules. Due to the setting making them themselves, they will be able to make them simple enough for everybody to understand and follow. This will ensure that the healthy and safety within the setting will be followed correctly and there will be a reduced risk of people getting hurt. Members of staff will also be aware of what to do if a child falls poorly whilst attending the setting. Another positive is that it will give the staff, parents and children a sense of security as they will know they are safe and are able to relax. Therefore, there will not be any one getting stressed, worried or frustrated at the thought that someone might get hurt, as all hazards should have been removed to reduce the chance of this happening. On the other hand, there are also negative points about health and safety as an operational system. This is because, it can be quite time consuming for the setting to create, therefore this may be taking up members of staff valuable time that needs to be spent else where. Due to this, another part of the setting may not run as it should, for example, lunch time. There may not be enough members of staff helping out at that time if some are busy creating and readjusting the operational system. Also, to add to the time of creating it, someone needs to take the time to review the system and add or take away things when it needs updating. This could be very costly to the service because they will have to pay for things like the system to be printed, staff training on the different systems, and health and safety is a big system for staff to become knowledgeable about. Security of the building: The main impact that security of the building has on early years or play work services, is that it keeps everyone safe. Settings will have equipment installed to ensure that only the correct people are entering the building, for example, they may have a bell or a password on the main entrance door, and other doors are only able to be opened from the inside. This also means that they are able to adapt the building however they need. Some nurseries may have to have walls, gates or fences built around their outdoor play area. However, some building may not have to do this as there is already a wall there. Due to this, the setting will also be able to install equipment that will be suitable to the children’s needs. Some settings may have high door handles that the children cannot reach so they can’t let themselves out or open the door and get their fingers trapped in it. A sense of security will also be built up in the setting as everyone will be aware that it is secure and safe. This may also make parents feel better leaving their child at the setting. However, like any operational system, this one also has negatives aspects. Finding a good quality company to get the equipment off and for them to install it may become difficult. A setting will need a reliable company who is willing to come out at late notice when possible to install equipment. The setting also needs to be able to find a company that has their equipment at a reasonable price or else it may become very expensive for the setting. If a good quality company cannot be found, then equipment could be faulty putting the staff, children and visitors safety at risks. It could also then take a long time for the setting to be able to get the equipment fixed, causing problems and unneeded stress. As some equipment might be seen as good, there are also some impractical equipment, for example, if the setting has a bell for people to get in, it may be too loud and then wake up the children who are trying to sleep. Task 3: Within an early years or play work setting there is an operation system for the management and ordering of supplies. One current operational system that I have witnessed was at my primary school. Each classroom teacher recorded the supplies that they might need throughout the term, including books, pencils, paint, games, and work sheets and so on. Once they had done this, they then had to send their list to the lady in the office who would record what supplies the teachers requested onto an ordering form. She would also keep a record of what each teacher asked for so everyone could have the correct stuff. When it came to ordering things like food for school dinners, this was the chef’s responsibility. Each morning, the classroom teacher would ask each child who was having hot dinners what they would like, and there would be a meat and a vegetarian option. From this the chef would then be able to cook the correct amount of food each day. To order fresh food, the chef would do this once a week handing the order list to the office. However, with things like tin food, this would be brought in bulk at the beginning of each half term. For cleaning equipment, the head cleaner would create the ordering form to give to the office and this would include providing cleaning wipes for tables outside each classroom and soap for the toilets and so on. When it comes to the management of the operational system, this is down to the lady in the office as she is the one who rings through to the companies and places the orders and makes a time and date in which everything can be delivered. She keeps a record of past orders to make sure they are roughly ordering the same things each time an order is put in. This will help financial budgets as well. I do believe that the schools ordering of supplies operational system works effectively. The operational system is working well because there is someone to monitor what is being ordered and manage the system. This helps so staffs are aware who to send their order form to, if there are any problems then there is also someone that they can approach to try and solve the issue. All staff is able to put in an ordering form so nothing gets missed and the person in charge is then able to check the orders to ensure that staff are not spending too much money and are being realistic so the school can afford it. The school order supplies at realistic times to ensure that they do not run out of things they need especially things like hot dinners for the children. As a school, they have built up a good relationship with their suppliers and in time of need they can get a next delivery if something drastic happens. Another good point about this operational system is that the person, who manages it, also manages the financial records meaning that they will have a good understanding of what is coming in and going out. They will also be knowledgeable of how to make orders and will know appropriate times in which it can be delivered. however, the only problem is, if the member of staff who always puts the orders through is off work due to sickness, holiday or anything then it could mean that the school do not get there order through on time as know one else will know how to do. Therefore it would be a good idea for them to allow another member of staff knows how to do it so they can make an order if needs be. Schools need financial resources to function. School finances should be carefully managed according to regulations. Financial summaries provide information about the flow of a school’s financial resources, both into the school (income or revenue) and out of the school (expenditure). Financial records within the school are kept within the management office together with all supporting documents, e.g. receipts, invoices, bills and payment records. Access to financial records is restricted to the head teacher and member of staff in charge of the finance. The school has to keep their financial records for a minimum of 5 years. Financial records are kept both on the computer and in filing cabinets. The school has a spreadsheet on the computer in which everything they have to pay for is listed and all the incoming money is also listed. The financial records that are kept in the filing cabinet include things like receipts for orders, and things that they cannot put on the computer. Receipts allow the school to look back to ensure that the money going out is the same as the receipts for things that they have brought. The school has to record their financial income and expenditure. Income that the school records include: school fees, renting out facilities, donations, local community, government and expenditure that the school record includes: construction/repairs, equipment, and rental of premises, teacher salaries, school meals, electricity, telephone, water and maintenance. Shifting Views on Native Americans in the Film, Dances With Wolves A wounded soldier lay on an operation table. The scene is surely not that unusual. 150 years ago, the medical field dealt with gangrene and infections by amputating any wounded limb. Now John Dunbar finds himself in almost the same situation. On a stroke of luck, as it would turn out, the doctor feels to tired to complete the operation on Dunbar and decides to finish for the day before taking his leg off. In the moments that followed, a frustrated, confused and disillusioned Dunbar pulls his boots back on and stumbles back onto the battle field. Feeling like there is nothing left to live for, Dunbar mounts a horse and charges the stagnant enemy line, bringing the battle to full fledged combat. Though his original intent I feel was not to start the battle, but rather to end his life, he becomes a hero, seeing that he wasn't shot or wounded. His cowardly actions in a twist of fate, ironically landed him as a decorated soldier. Due to his position, Dunbar was given the option to go where ever he wanted. This was a customary option for war hero's of his time. Being the romantic type, as depicted in the film, he requested to be sent out west to become a US marshal. He felt a calling to see the Old West before it was gone. Upon his assigning to his post, it was understood that he was an Indian hunter. So, he was sent to a completely unmanned post in the west. Here is confronting with an interesting sequencing of events that would eternally change his life. The American Indians, in the eyes of virtually everyone moving west, were considered the enemy. I didn't get the impression that Dunbar or his traveling counterpart felt any differently as they the stopped and carefully and with concern, inspected a human skeleton with arrows in it. Commercialization of the Navajo Sand Painting Practice

For the West, art has traditionally been considered as the mark of civilization, in so far as humanity is able to capture and render the essence of beauty and preserve this through their â€Å"artwork.† ( Gilbert, 1982; Errington, 1994; Witherspoon, 1977)   Indeed, art may even be a purely Western construct â€Å"since textiles and jewellery, clothing and cosmetics (to mention only a few of the contexts where aesthetic choices operate) are not usually considered by us to be Art with a capital ‘A'.† (Gilbert, 1982: 168) The understanding and appreciation of non-Western â€Å"art† has therefore been problematic for many scholars, given that branding such cultural products and practices as such carries with it the enthnocentric connotations of the Western definition which usually defines â€Å"art† based on the value system of Western culture (Gilbert, 1982: 167-168; Errington, 1994: 203; Clifford, 1988:221) that, as Robbins (2005) points out, has become more and more concerned with the accumulation of material wealth and the derivation of fulfillment from the consumption of products (Robbins 2005:20) and where the perception of beauty is lamentably static. (Witherspoon, 1977:152) Critics have likewise noted that â€Å"art† in the West has often connoted being â€Å"art by intention,† which are produced and valued to be perceived for their beauty and for the monetary value that they carried.(Errington, 1994: 201) This is distinguished from what is considered as â€Å"art by appropriation† or the things that were produced for purposes other than art but are appraised to be of high value with antiquity or the possession of an indigenous or unique identity, thereby alienating them from the culture that produced them. Witherspoon (1977), for instance, emphasizes the importance of defining indigenous behavior, institutions, and practices within the context of their culture or at the very least, â€Å"against the backdrop of their view of the world or their ideological frame of reference.† (Witherspoon 1977:4) This includes confronting the fact that these cultures often evolve or even change with their exposure to other cultures and vice versa. The dilemma over the treatment and definition of non-Western art is illustrated, for instance, in efforts to preserve Navajo sand paintings so they could be sold and collected (Errington, 1994: 203). The sand paintings which were originally used in Navajo religious rites and healing ceremonies have been described as â€Å"true masterpieces of art† for their â€Å"instinctive awareness of the basic principles of design, colour harmonies, and contrasts.† (Foster, 1963:43) Ironically, the sand paintings were created by the Navajo not for art’s sake but as an integral part of religious healing ceremonies to locate and reestablish of an individual in his or her right place in the the universe and thus cure his or her illness. These paintings often utilized colored sand, cornmeal, and other bits of material to depict the Navajo’s vision of the cosmos and to symbolize their socio-economic life and other cultural elements.(Robbins, 2005: 14; Foster, 1963: 43) Foster (1963) notes that the Navajo was able to make over a thousand designs from symbols and patterns that were unique to them, and how, after the sand painting had been painstakingly drawn, the shamans would proceed to rub parts of the design on the individual who was to be cured while praying through chants. For the Navajo people, the sand paintings were indeed relevant not only as a religious tool but also as a source of magic. Horrified by the fact that these intricate sand paintings were often destroyed by being sat on or rubbed off during the healing process and thrown out afterwards, â€Å"concerned† individuals found ways to keep these intact using glue and other materials. (Errington, 1994: 203) This concern to preserve the end product of a cultural practice for its artistic or aesthetic value, however, contrasts sharply with the Navajo’s concept of beauty that lies more in the creative process that is inextricably linked with their way of life itself. Thus, beauty for the Navajo lies not in the sand painting that has served its purpose in curing a community member’s illness but in the entire religious ceremony where the sand painting is but a small component. The careless tendency to preserve or collect â€Å"art† from other cultures therefore engenders the superimposition of   another culture’s value systems and assumptions of meaning on the cultural practices or even the products of cultural practices (Errington, 1994: 205). This is especially true in the case of the sand paintings, where the preservation enabled them to become â€Å" durable and portable, able to be moved to new locations, and hung on the walls as â€Å"art†Ã¢â‚¬  (Errington, 1994:205). With this transformation from a religious and highly significant part of Navajo tradition to a home or museum artifact, the Navajo sand painting tend to lose its significance as it became divorced from the culture that produced it. Thus, the Navajo sand painting seem to have lost its meaning as it became more and more commercialized. Approriated as art, the practice became insignificant insofar as the culture and the community that practiced it disintegrated, devoiding sand painting of its ritual meaning and significance. Leadership Assignment 5 Sarah Kamal 09-4714 ————————————————- 26th November 2012 Question 1: Was the research program a group or a team? If a team, what kind of a team was it? At first, before the assignment of a formal leader, it was a self-directed team on a whole of groups of people. It was a team because it was not inhibited by organizational boundaries. It was specifically formulated for a purpose and vision that was to develop a technique for large-scale interferon production to use as a treatment against cancer.The performance goals were also set by themselves instead of one strong centralized leadership. This team consisted of 3 groups who had 3 informal leaders namely –gene slicing, recombination and fermentation. At first the senior management believed that this biotech research program could be self-managed so the initial team of groups was a self-directed team as it worked on itself within its group boundaries autonomously and was member centered to the informal leaders.Later on after the formal leader was assigned to this team, it emerged as a stronger cross-functional team coordinating across its group boundaries for a shared purpose and problem solving. The formal leader directed work to the group leaders and assigned some authority to them as well. Question 2: Did the interdependence among the subgroups change with the interferon project? What were the group norms before and after the retreat? Interdependence is the extent to which the team members depend on each other for information, resources or ideas to accomplish their tasks.The research project should have been ideally a reciprocal interdependent one but initially the lack of communication and cohesiveness among the subgroups made it a pooled-interdependent team as the groups were fairly independent and did not share or coordinate work with each other participating as a te am. After the formal leader came, he changed this interdependence style to the required reciprocal interdependent team. The interdependence increased a lot, and the team members influenced each other in reciprocal fashion for he completion of work and problem solving. Yes, the group norms changed and one single approach was taken to lead the project with consensus. Each subgroup was assigned a set of instructions by the leader, strict deadlines were given as the work was highly interdependent now and weekly progress reports were submitted. The communication gap was removed, problem solving was improved and group coordination was increased. Question 3: What factors account for the change in cohesiveness after the chief biologist took over?Cohesiveness is the extent to which the members are united in pursuit of a common goal. The chief biologist increased the determining factors for increasing cohesiveness. He took the team to a two day retreat and made them interact with each other. He organized the work and gave the team a more direct shared mission. Even after the retreat the communication was increased as lunches and coffee gathering took place. Group members and team leaders started having daily discussions and cooperated on research requirements. Enthusiasm and group cohesion was increased.

The average layman does not know much about the atom but in this paper I will explain what and why they are. The word atom comes from the Greek word meaning indivisible. The concept of the atom had its foundations in ancient Greece with Leucippe of Milet. In 420 B.C. his disciple Democrite of Abdere had the concept that atoms were particles in perpetual motion and were invisible because of their infinitely small size, indivisible, solid, eternal because they are perfect, surrounded by an empty space, and having an infinite number of shapes. His theory was exceptionally close to reality, being that it was 420B.C. Today we know that each atom is made up of three parts, a proton, a neutron and an electron. These atoms combine to make compounds. The most basic atoms are called elements and cannot be broken down any more than they already are. There are currently 118 known elements 90 of them occurring naturally and the other 28 are man made. The elements combine in an infinitesimal amount of ways to make up every thing around us. Created in 1869 by Mendeldiev the periodic table of the elements is how we chart these elements. Each column on the periodic table is categorized by the amount of atoms in its elements outer field. Hydrogen, Lithium, and sodium all being in the same column on the table have the same amount of atoms in their outer field. Since the electrons in the outer field dictate the types of chemical reactions that an atom can have, the atoms in the same column have some of the same properties (chemical reactions). We already know that atoms are made up of three different parts (protons, neutrons, and electrons) but how do these particles interact. Or maybe you've been in an accident and the other person has offered to settle with you if you sign a waiver of subrogation- should you do it? What is subrogation, really? Before you decide, you'll need to understand what subrogation is and why you would (or wouldn't) want to waive it. In this guide, we define subrogation and explain when and why it occurs to help you make an informed decision. What Is Subrogation? In layman’s terms, subrogation occurs when Person A owes something (usually money) to Person B, and Person C steps in and legally takes Person B’s place (including the rights to what Person A owed to Person B). An example would be if you owed money to a loan company and someone else bought your debt. The person who bought your debt could then use subrogation to have you pay them back the debt (even though you didn’t borrow any money from this person originally). Here’s the more technical subrogation definition: â€Å"The substitution of one person in the place of another with reference to a lawful claim, demand or right so that he who is substituted succeeds to the rights of the other in relationship to the debt or claim, and its rights, remedies, or securities.† (source: Black's Law Dictionary) You’re most likely to encounter subrogation when dealing with insurance claims, but it can also crop up in situations with guarantors (like co-signers of a lease or a loan). How Does Subrogation Work? Because the most common place people encounter subrogation is in dealing with car insurance, I’ll explain it through an example of a car insurance claim. Let’s say you're driving along the highway one day and you get into an accident with another driver. One of your brake lights is cracked, your rear bumper is hanging off one side, and you need a new paint job. To pay for the repairs to your car, you file a claim to your insurance company with the other driver’s insurance information and cross your fingers. If your insurance company determines the other party was at fault, they’ll pay the claim to cover the damage (minus your deductible). You get your car repaired, and your life goes on as usual. Behind the scenes, however, your insurance company will seek to recover their costs from the other party’s insurance company (or if that’s not possible, from the other party). It is the right of subrogation that allows your insurer to seek to recoup the money that they paid out to you in the claim from the at-fault party. For the most part, the only involvement you'll have in this whole process is if your insurance company chooses to pursue subrogation. If they do, they’re legally obligated to inform you and attempt to recover the cost of your deductible as part of the money they're seeking from the at-fault party. If your insurance company does pursue subrogation, they'll require you to cooperate with their subrogation attempt. Among other things, this means that you likely won’t be permitted to sign a waiver of subrogation after an accident or claim. What Is a Waiver of Subrogation? A waiver of subrogation means that you give up your right to have another party (usually your insurance company) attempt to recover what a third party owes you. Let's return to the example of car insurance for a moment. Most insurance contracts forbid you from signing a waiver of subrogation after you’ve already filed a claim. You may be able to sign one in advance of any accident if your insurance allows for adding waiver of subrogation endorsements to existing policies. If you do this, however, your insurance company might charge you an extra premium to try and minimize their losses that way. By signing a waiver of subrogation, you waive your car insurer’s right to try to recover their costs (including the cost of your deductible). You’re most likely to come across waiver of subrogation clause after an accident if the at-fault party in the accident or their insurance company attempts to settle with you directly (without going through your insurance company). They’ll want you to sign a waiver of subrogation so that they’re not at risk of being hit up twice for the same incident (once from you, once from your car insurance pursuing subrogation). In most cases, your own car insurance will require you to notify them if you’ve decided to sign a waiver of subrogation (just as they have to notify you if they opt to pursue subrogation against the at-fault party or their insurance). That way, your insurance company won’t waste time and legal fees trying to get back money the at-fault party already paid out to you. Should You Sign a Waiver of Subrogation? While signing a waiver of subrogation can save you the hassle of lawsuits and dealing with insurance claims, it also means you’re far less likely to be able to recover any non-out-of-pocket costs (like all or part of your deductible). If you let your insurance company pursue subrogation, they become responsible for all the legal fees and paperwork and hassle- all you have to do is wait and see if they’re successful in recovering any of your deductible. Therefore, you should be very cautious about signing a waiver of subrogation clause, either in your car insurance contract or for a settlement after an accident. Not only might it be forbidden if you’ve already filed an insurance claim and didn’t have a waiver of subrogation signed with your insurance company before, but it could also mean that you end up with a smaller payment than you would otherwise. The only reasons to consider signing a waiver of subrogation are if: you have sizeable out-of-pocket costs that you’re hoping to recover (since your insurance company can only pursue subrogation for costs they’re responsible for), OR you believe you’ll be able to get a more favorable settlement than your insurance company would Even in these cases, however, be aware that if you sign a waiver of subrogation after the accident, your insurance might refuse to pay all or some of your claim (making it imperative that you win your suit against the at-fault party or their insurance). Other Kinds of Subrogation Aside from dealing with car insurance, you might encounter subrogation claims in a few other situations. Subrogation will most often be at issue when it comes to various types of insurance, including homeowners’ insurance- and health insurance-related subrogation claims, but it can occur with contracts of any sort. In the next couple of sections, we'll discuss the other two most common ways you'll come across subrogation in your day-to-day life: health insurance and student loan repayment. Health Insurance Subrogation For health insurance, subrogation most often comes up in the context of personal injury lawsuits. If you successfully sue another party for medical damages, your health insurance will often make a claim for part of your settlement through their right of subrogation. This might seem strange at first, but it turns out there’s a good (and in most cases, fair) reason for this. As with car insurance, when you sign up for health insurance, part of what you agree to is that the health insurance company will pay your claims on the condition that it has the right to seek reimbursement for your claims from whoever is responsible. When you go to the doctor’s office, you’re the responsible party, which is why you pay your premiums and have a co-pay. When it comes to a situation where you’ve been injured in an accident by a third party and have successfully won a suit against them, however, this changes- that third party is now responsible for your medical bills. If your health insurance company is to get reimbursed at all for your medical expenses, it must be from that third party’s payment to you. They can’t claim it from the third party themselves – otherwise, you’d be getting doubly reimbursed (your medical bills paid by the insurance company + the settlement from the third party), and the third party would be getting doubly charged, which is against the law. So while it might seem unfair that your health insurance company gets part of the settlement, it makes sense. The good news is that you won’t have to pay more than the insurer would pay for the same services. For instance, if a hospital charges $2,000 for a lab test connected to your treatment but your insurance company only has to pay $400, you would only owe the insurance company $400 out of your settlement. Student Loan Subrogation Currently, the federal government offers direct student loans, which means the loans are offered directly through and guaranteed against default by the Department of Education. If you took out a federal student loan before 2010, however, your loan would have been guaranteed by a separate student loan guarantor agency. If your loan involves a guarantor of any kind, it could be subrogated if the agency that originally guaranteed your loan you sells off your loans to a third party. The most common case where this occurs is when the Department of Education buys back a loan from one of these agencies. Unless it is otherwise prohibited by law or the loan contract you originally signed, the Department of Education can then step into the shoes of the original student loan guarantor agency to collect the loan back from you, even if you had defaulted on the loan. Besides causing you the financial burden of having to pay back a defaulted student loan, student loan subrogation will also have a negative impact on your credit score. Because the subrogation means that you now technically owe money to someone new (even though you haven’t taken out a new loan), your defaulted loan will reappear on your credit history and cause your credit score to drop. Subrogation Claims: The Bottom Line You can define subrogation as what happens when you owe something (usually money) to one entity and a second entity steps into the shoes of the first entity to collect what’s owed. Subrogation most often comes up in the context of car insurance claims, but it can be pursued under other circumstances as well, including health insurance claims and student loan repayment. In the context of insurance, you might be able to sign a waiver of subrogation endorsement before any issues arise for an additional premium. If you try to sign a waiver of subrogation afterwards, however, you might end up having your insurance claim partially or totally rejected. This saw the beginning of the Radical Republican party which was made up of the northerners because the southerners were still in the congress (Colains & Marler, 2008). The Racial Republican then took the initiative of passing important Civil Rights Acts that counteracted the new black codes of the south. In 1865-1915, there was the second historical event which was named industrial Revolution. At this time, US tried to evolve from a low economic backwater to be the most powerful economic country in the world. The nation’s main energy source which was mainly powered by humans and animals changed to mechanical power (Roberts, 2010). The railway industry expanded at this time from 30,000 miles of track to around 250,000 miles. These improvements lead the movement of goods and products to be easy, reliable and cheap. In addition to this; the steel industry was the main contributor of the massive expansion of railroads (Mckenzie, 2007). In case J ohn Wilkes would have not assassinated President Lincoln, many things could have changed, and one of the issues that could have changed drastically is Reconstruction. First, in the case of Lincoln, he could have tried to be more diplomatic to the south this was not the case with President Johnson because his main interest was to punish the southerners. Lincoln was more guided in favour of diplomacy and compromise (Selden, 2010). Secondly, the Radical Reconstruction could have been different from what happened. Those people who were radical thought that Lincoln was much softer to the south and could have revolutionized the southern institutions, habits and manners; they all wanted the south to be reconstructed according to the new order. They were mainly idealists whereby they were mostly driven by religious views, these Republicans were not for the idea that the blacks were low-grade and consequently, they requested that complete social, political, and civil privileges for slaves to be administered and respected. The Radical Republicans dominated in congress and they clashed with President Johnson often (Mckenzie, 2007). Johnson policies were on how to carry out reconstruction according to Lincoln, but the motives were not the same with those of Lincoln. The industrialization and urbanization revolution of the 19th and 20th centuries generally changed the urban life of many Americans and gave them chance to improve on their living standards.
